Types of commercial disputes we can help you with

We work with a broad mix of large commercial organisations, family businesses, farming and agricultural partnerships,  owner-managed businesses, utilities companies and government organisations. With experience in a wide range of disputes, in particular, we are well known for:

  • Breaches of commercial contracts, particularly relating to the supply of materials, aggregates and manufactured goods, as well as the supply of services, software, and IT service agreements.
  • Disputes involving shareholder claims and director duties, particularly over the sale and purchase of share agreements such as warranty claims and breach of restrictive covenants, as well as claims against directors for breaches of fiduciary duty and claims for misfeasance and civil fraud.
  • Procedural applications and appeals in the highest courts, regularly appearing in the High Court, Court of Appeal and Supreme Court where we have been involved in a number of cases acting on behalf of  the European Commission and the European Council and including other parties such as the Competition and Markets Authority, Pfizer, Visa and the State of Romania.
  • Construction disputes, where tight deadlines, budgets, subcontractor schedules and contractual obligations converge and cause disagreements.
  • Professional negligence disputes where businesses and professionals are accused of failing in their duty of care to a client or customer where we are working to protect the business and its reputation.
  • Injunctions and emergency remedies, guiding clients through the process of making applications to court in response to another party’s behaviour or wrongdoing that threatens their interests including preserving evidence and assets.

Examples of some of our recent commercial dispute matters

Our recent experience includes:

  • Defending a multi-million pound claim relating to the supply of allegedly defective concrete blocks using in various housing development sites in the South East.
  • Advising an engineering company on a claim against a former director who fraudulently took money and assets from the company, funding his lifestyle through the company for many years and falsifying expenses claims.
  • Advising a national waste and recycling services provider in a dispute with a national bookmaker, who breached a multi-million pound contract for collecting waste and recycling from thousands of their sites across the country.
  • Acting in High Court proceedings on behalf of a partner who had been unlawfully expelled from a partnership, in circumstances where the remaining partners were seeking to withhold considerable monies and assets.
  • Acting for the European Commission as Intervener in the Supreme Court in the highly publicised Interchange Fees Case involving, amongst others Visa, Mastercard and Sainsburys Supermarkets reported at [2020] UKSC 24

Our fees and costs

Litigation can be costly and unpredictable. At the outset of any case, as well as advising you on a proposed course of action, we will always try and give you an estimate of how much your case will cost. If this is not possible, we will always give you a sense of the possible levels of likely costs.

We generally charge fees at hourly rates and we will typically send you a bill every month so that you can keep up to date with how much everything costs. The amount will depend on how much work we have done that month.

In addition to our fees, you may also have to pay extra money up front for a barrister or court fees, or fees for an expert to advise on a particular area. These additional costs are known as disbursements and need to be paid in advance.

There are also a number of alternative funding options for litigation. For example, we have relationships with After the Event Insurers (ATE), while specialist Litigation Funders are becoming increasinly common in large disputes. We are always happy to explore all options that may fit your case.
