The Government has launched a twelve-week consultation into the Lasting Power of Attorney regime.
Parts of the current paper-based regime are 30 years old and are in need of modernisation.
The consultation will look at making the process of creating and registering a Lasting Power of Attorney quicker and easier and will look to introduce a predominantly digital service. The consultation will also look at whether the Office of the Public Guardians safeguarding remit should be expanded.
One area of interest in the consultation is whether an urgent Lasting Powers of Attorney registration service is possible. At present a Lasting Power of Attorney takes 2-3 months to be registered which often causes problems and distress to families at what is often an already stressful time. Having a quicker route available when circumstances require it would be a major step forward in helping families look after the affairs of their loved ones when they need it most.
