Personal Injury - Brain Injury Team

If you suffer a brain injury, you need a solicitor who understands the wide ranging effects of such an injury on you and your loved ones.

A brain injury is often described as a "hidden disability" because sufferers can appear to the outside world to be physically fit and able. In fact, they are struggling to cope with disabling problems such as:

  • Poor memory
  • Poor concentration
  • Difficulty problem solving
  • Severe fatigue
  • Slow physical and mental response
  • Personality change
  • Mood swings

Family members, carers and friends are usually the people who truly understand and identify the impact of such changes and the stresses that arise from them. They are key to a solicitor's understanding of your injury and needs. In addition to the hidden disabilities, brain injuries can cause more obvious serious physical disabilities which impact on your ability to walk and balance. Severe injuries affect speech and the senses.

The Langleys Brain Injury Team understand that you may have no memory or limited memory of what happened to you.  However, we strongly advise that you speak to a specialist solicitor, approved by Headway, to discuss whether the accident was avoidable and not your fault.  We need to speak to you, your family and anyone who knows what happened as soon as possible to advise whether a claim can be pursued.

The sooner that you instruct a specialist solicitor, the sooner that they can start working to find out what happened. An award of damages could make a huge difference to your life if you have long term difficulties which affect your ability to work or if you need someone to look after you.

What if I have an urgent need for money or help for my injuries now?

Our specialist brain injury team recognise that your injury and your family's needs must be looked at on an individual  basis and promptly.  We work with numerous experts who are skilled at identifying and recommending treatment and therapy for all aspects of a brain injury.
In certain circumstances, where we are able to prove that the injury occurred as a result of negligence, we will be able to obtain an interim payment.

Langleys will:-

  • Talk to you and your family about your immediate worries following a brain injury
  • Advise you as to whether a claim can be pursued
  • Advise you on what it will cost to take a claim.  In many cases, we are able to access legal expense insurance for you or act on a no win no fee basis.  If the brain injury arose as a result of medical treatment, Legal Aid may still be available to you
  • Interview witnesses and find out what happened, liaising with the police and any insurers
  • Take pro-active steps to initiate the claim as soon as possible
  • Consider applying for an interim payment
  • Instruct experts to see you and advise on the extent of your injuries, needs and future prognosis
  • Follow the rehabilitation code

Rehabilitation: What does this involve?

Early access to a brain injury rehabilitation programme and treatment for all aspects of your brain injury is the best way to aid your recovery.  In the field of rehabilitation, we will consider:-

  • What therapies you need, e.g. counselling, physiotherapy, occupational therapy
  • Care support
  • Buying equipment and aids which will help you
  • Adaptations of the property that are required in the short and longer term
  • Case management
  • Re-education and re-training

In both offices we have specialist lawyers, approved by Headway, who have supported families, carers and brain injured people through difficult and complex claims.  Afterwards, such clients remain in touch and value support in respect of management of related financial issues.  Some clients cannot manage their own affairs following a serious injury.  We also have an experienced team within the Private Client Department who can advise on:

  • Special Needs Trusts to protect your entitlement to claim means tested benefits
  • Involvement of the Court of Protection

We are good listeners, a friendly and approachable legal team. Please ring us on 01522 888555 (Lincoln) 01904 610886 (York) for a preliminary chat to see if we can help - whatever your concerns.
