The administration of an estate is not simply a matter of closing bank accounts and selling property. Steps need to be taken to locate a Will, or if there is no Will to ensure that the estate is administered strictly in accordance with the Intestacy Rules. A Grant of Representation (also known as either a Grant of Probate or Letters of Administration) is likely to be needed – please see our FAQ and Glossary pages for some general information regarding terminology and the administration process.

The correct taxes need to be paid – not only inheritance tax but also income tax and capital gains tax – and consideration often needs to be given to the correct valuation of assets, the payment of debts and the personal situations of the beneficiaries under a Will. The Personal Representatives also need to take steps to protect themselves against claims against the estate, be it from disappointed beneficiaries or unknown creditors.

We are experienced in dealing with both simple and also very complex estates, for example those including business assets, investment portfolios or agricultural land and farms. We are also able to advise on:

  • tax mitigation
  • the redistribution of assets through the use of Deeds of Variation
  • entitlement under the rules of intestacy
  • possible claims against an estate under the Inheritance (Provision for Family and Dependants) Act 1975 – should such a claim arise we are able to work with our Dispute department to help resolve the claim.

We are happy to assist in all parts of the administration process, be it by simply giving initial advice, to obtaining the Grant of Probate or Letters of Administration, to administering and distributing the whole estate.

All three include the application for the Grant of Representation, along with other services depending on your requirements.
