Pre & Post-Nuptial Agreements

Whilst no one wants to think about the end of their relationship, the reality is that sometimes marriages do break down, leaving both of you feeling unsure and uncertain of where you stand and your entitlements.

Although a court does not necessarily have to follow an agreement made before a marriage, it provides a useful starting point and, when drafted properly, should prevent a lot of uncertainty if the worst should happen.

Although not right for everyone, pre-nuptial agreements are worth considering for several reasons, for instance if you are getting married for the second time, or if one of you has an inheritance or business you wish to protect.

Whilst it’s romantic to think that you’ll never need to use such an agreement, the reality is that, if the relationship does come to an end, pre-nuptial agreements can prevent a great deal of stress, disagreement and financial vulnerability, and it’s worth finding out sooner rather than later if you may benefit from such an agreement. 

If you are already married but are considering how best to protect assets that were perhaps acquired before the marriage or have been received from outside of the marriage it would be sensible to take advice on whether a post-nuptial agreement would be appropriate.

How we work

The first stage for us is to meet with you, free of charge, to listen and understand your situation and your intentions.

While some firms limit an initial discussion to 30 minutes, we will speak to you for as long as it takes us to build a complete picture of what you are hoping to achieve.

When we have that clarity, we will outline the process, explaining the likely timescales and costs, as well as the team that will support you. The team will always be led by a partner, aided by more junior team members. We know from prior experience that this will give you the right mix of skills, knowledge and value.

We understand that it can be particularly sensitive to have discussions with your partner or spouse in circumstances where your relationship is continuing, but you are contemplating what will happen if your relationship ends.  We always approach these matters with sensitivity and work collaboratively with your partners lawyers, should they have one.

We aim to find a resolution that reflects both parties’ intentions and takes into consideration the likely needs of each party and any children should the relationship breakdown in the future.

Fees and costs

If you would like us to work with you, you will need to pay some money upfront; this is known as providing a ‘payment on account’. This is typically £500, but could be more if you have an imminent court hearing or other substantial work that needs to be dealt with straight away.

For our fees, we will typically send you a bill every month so that you can keep up to date with how much everything costs. The amount will depends on how much work we have done that month.

In addition to our fees, you may also have to pay extra money for a barrister (if you use one) and court fees. These are known as ‘disbursements’ and will need to be paid in advance.
