Expert advice on your will and administration of your estate after you have gone

We understand that talking about your will, or the affairs of a loved one who has just died, can be difficult and upsetting. We have lots of experience in helping people in those situations, and we are here to listen, advise and help you in a sensitive and straightforward way.

We have lots of involvement in dealing with people’s affairs and sorting out difficult family or financial situations.

Dealing with an estate can be more complicated than simply closing bank accounts and selling property. Frequently, you will need professional advice to ensure that liabilities are identified and settled, the correct amount of tax is calculated and paid and that the estate is distributed according to the deceased’s wishes.

It is important that if you are dealing with an estate that you protect yourself from claims which may be brought against the estate. This can happen if there are disappointed beneficiaries or unknown creditors.

Our large team of sympathetic and trusted lawyers will help you organise your affairs. Our services include:

  • Drafting of wills and supporting documents
  • Obtaining grants of representation
  • Acting as executor and trustee
  • Administering estates to ensure assets pass in accordance with the will or the intestacy rules if there is no will
  • Contesting wills, will disputes and disputed probate cases
  • Advising on foreign assests where the deceased was domiciled abroad.

We work throughout this country and also support clients in other jurisdictions.

We have the largest team of STEP (Society of Trust and Estate Practitioners) qualified Solicitors in Lincolnshire. We routinely deal with large and complex estates on which inheritance tax is payable or would otherwise be payable but for the use of exemptions or legitimate planning strategies such as Deeds of Variation upon which we have expert knowledge.

Types of will and probate work we can help you with

Will planning

A will is likely to be the only document you ever sign which deals with absolutely everything you own. It is the document which passes all of your hard-earned assets on to your family and other beneficiaries.

The increasing complexity of modern life means that will planning has never been so important. Second marriages, blended families and large or intricate estates make the process of distributing assets after a loved one dies extremely complicated if a proper will was not created.

For those who do make a will but choose the quick ‘off the shelf’ or DIY option, problems can arise in the future. Important sections can be missed, resulting in loved ones not receiving gifts as intended, unnecessary tax liabilities, claims by disappointed beneficiaries and even challenges to the very validity of the will itself.

Probate services and estate administration

If you have just been bereaved and do not want to deal with the estate administration yourself, we can manage all the paperwork and financial matters on your behalf in a sensitive and efficient manner.  Alternatively, if there are only certain elements of the estate administration you would like assistance with then we can help in a more limited way too.

Our knowledgeable bereavement and probate solicitors are experienced in handling all types of estates, from the administration of straightforward estates to complex matters involving businesses, investments or land and farms. We also have experience of advising on foreign assets and where the deceased was domiciled abroad. We can provide you with peace of mind that your loved one’s estate is properly distributed, legally and in accordance with their wishes.

Examples of our will and probate work

Our private client team supports a variety of people and families, our recent work includes:

  • Advising a business owner and family on their wills. Their property portfolio has experienced significant capital growth over the years, and we are helping them as to ways to minimise potential tax bills.
  • Representing a family who’s loved one left a complicated and varied estate including lifetime trusts and lifetime land transfers. We supported them by dealing with the estate administration and helped them understand what the implications would be for them in the longer term. We worked closely with our agricultural team regarding the transfer and sale of the remaining land issues.
  • Worked for a family with a complex estate that had numerous failed gifts and lifetime trusts.

How we work

Everything we talk about throughout the time we spend working together will always be totally confidential.

Offering expert advice and guidance, we will recommend a path that helps you take control of the situation and leads to a resolution that works for the situation you find yourself in.

Whatever your reason for coming to us, our first step is always to listen with patience so that we understand what has happened before and what you want to happen next. Rest assured that there are very few scenarios we have not encountered before or challenges that we have not previously overcome.

Using our knowledge and experience we guarantee that we will be able to give you a range of options, with a detailed overview of the likely process, outcomes, timescales and costs.

Our team

We have one of the  largest team of STEP (Society of Trust and Estate Practitioners) qualified Solicitors in our region. We routinely deal with large and complex estates on which inheritance tax is payable or would otherwise be payable but for the use of exemptions or legitimate planning strategies about which we have expert knowledge.

Our dedicated specialist team is independently rated as one of only a few Tier 1 specialist Departments in our regions by the Legal 500 and Chambers and Partners so you can be sure that you are being represented by specialist lawyers in all aspects of planning your will and administering your estate.

Our team is also accredited by the Law Society as members of the Wills & Inheritance Quality Scheme.  This is a further mark of the team’s drive to ensure the best standards of Will drafting and estate administration are maintained.  Very few if any local firms are accredited by the Law Society to this scheme.

Our partners and lawyers have decades of experience and an excellent reputation in representing families in optimising their tax-planning and protecting wealth and assets for multi-generational enterprises.

We have teams in Beverley, Lincoln and York, and work with clients across East and North Yorkshire, Lincolnshire, the East Midlands and foreign jurisdictions.

Our fees and costs

Whether you want to talk about wills or administering an estate we offer a no obligation initial meeting.

For wills, at the end of that meeting we will be able to provide an accurate estimate of costs having fully understood your circumstances and needs.

Administering estates can be complex and it is not always possible to know the amount of work that is required at the outset.  We will agree initial estimates for the costs to certain stages of the administration process and discuss any further costs with you an advance once those stages are dealt with.  We will keep you regularly updated as to the costs so that you are aware of the overall position.

If you would like us to be involved in the administration on a more limited basis, perhaps to prepare certain documentation, then we will provide you with an estimate for that particular work.
